Got knocked off my 10R
« on: March 24, 2012, 07:34:41 PM »

Hi guys and girls, i signed up to this forum a while back but unfortunatley not used it much since, however Thursday afternoon i got knocked off my 2006 ZX10R and i have came back on here for help and advice.

I had just been to get a new set of tyres fitted to her, some new power pure 2CTs, on my way home approx 40 mile after having them fitted i was knocked off.

Where the bike ended up..... a fair distance from the impact.

Once picked up . . . .

I took a bit of a bashing my left leg came off worse which is currently in plaster from my ankle to my groin

The bike done a few flips before coming to rest upside down inches from someones front window. I have not started stripping the bike as yet but so far the main items IF my insurance does not pay out as i am TPFT only is...

Rear wheel
Rear subframe
Nose Cone, LHS Fairing, Seat Unit
Coolant bottle and poss radiator
Clock surround
LHS rear set and i am sure i have missed a few bits

Luckily from what i can see the whole front end got off with out damage, inc wheel, forks, calipers, stearing damer, bars ect ect so if anyone has what i need for sale please let me know incase i have to fund this myself. Hopefully not as i am currently job less and i have had nothing but bad luck latley.

Your luck is changing mate. You're still with us albeit battered and bruised.

Good luck fixing the bike.

I live in south Birmingham   :-(

As i was riding down a fairly quiet road i spot a guy pull out rather slowly in a small renault car, i spot him and start slowing down as i get behind him he is doing approx 20mph, he then starts pulling over to the left and not speeding up as if he is coming to a stop or not sure where he is going so i check my mirrors and make sure it is safe to pass, as i start accelerating / passing him he does a right turn and i go straight in to the side of him, he did stop but he was an oldish guy and pretty shocked i think. There was no whitnesses but i am unsure to what he has told the police as i only got back from hospital this afternoon.

Had exactly the same accident. Get a lawyer!!! Not the one "no win no fee" twats because it will drag for months- in my case 18months plus.
There was a bloke here on the forum specializing in bike cases. Don't let the old shaken bloke get away with it. I was knocked off by old ish lady almost crying then she lied through her teeth. It ended with 80%-20% in my favour but it took freaking ages.

Yes I am and I used excalibur solicitors from solihull. But as i said I dragged for more than year and a half. And if the bike wasn't insured comprehensive I would be basically screwed.
I will check index of members and maybe some name will catch my eye but i can't promise.

I hope you got his address and other details?

I would write down your version of the facts stating that you hold him liable as he cut across your path when exercising a legitimate overtake. I would take it round to his house and ask him to sign a copy. I would then pursue compensation, either through him direct (if he agrees) or through his insurers. Unfortunately, it wont look too good for you if you began your overtake approaching a junction, but if he didn't signal and admits this, that will help. Note down in your letter all the relevant facts pointing to his liability for the incident, including the fact that he didn't signal (if appropriate). If you get nowhere, you could still raise an action for damages via the County Court. The forms are all available on line or from the court office. You can do it all yourself without a lawyer once you have assessed the damage. There will be a smallish court fee to pay, but no big lawyers bills

Unless he intends to claim against you, your insurers wont be interested to fight your corner

Hope this helps
