Lost my car licence but was i hard done by?
« on: May 02, 2010, 07:58:30 PM »

Right sorry if i ramble on but heres my story to how i lost my car licence.

Back in may 2006 myself and a few friends went on a night out, one called ashley drove us all. At about 1pm ashley felt ill and ended up being taken to hospital (to later find out he had been spiked) even though he was drinking soft drinks. So as i hadnt been drinking either due to having work early hours the next day so i nominated myself to drive us all home in ashleys car. Doing so i was pulled over by the police for a "routine stop" I explained the whole thing and they were fine about it. Just as i was about to leave they told me it was coming up on their system as not insured (yet my insurance company had specfically told me i was insured to drive any other car 3rd party) anyway so we had to get a taxi home and leave the car for ashley to collect to next day.
We went to court a few months later and both received 6points, myself for driving without insurance and ashley for letting me drive his car uninsured (and yes he didnt even know about it!!!
We had both been driving under 2years so both lost our licences. Which i thought was out of order straight away but i shouldnt of took my insurance companies word for it and asked for it in writing.

So then in may 2007 i re took my full bike test which i passed. When receiving my bike licence in the post a few weeks later i noticed it said i had a full car licence aswell. Abit confused i called DVLA up and asked what licences i had and what i was entiled to drive/ride etc. They told me i had a full motorcycle licence and a full car licence, which i said are you sure can you check. I even said i havnt re-taken my car test though... I was told because i had re taken my bike test i automatically received my car one back.

So in may 2007 i bought a car and got insurance.. since then till current i have been stopped twice in the car both times the police looked at my licence and everything was fine. And three times on the bike everytime they saw my licence and said everything was fine.

Sooooo this week i received a letter from DVLA asking me to send both card and paper parts of my licence back to them as they have noticed it shows incorrect/incomplete details, obviously i called them up asking what was it about, women told me it shouldnt say i had a full car licence only a previsional. obviously i was mad that they had made an error 3year ago which i called to double check and they confirmed. So now Im left with no car licence which screws me up with work as im a self employed plumber and use my van to go around. Had to call my car insurance up and tell them im only on a previsional licence now which they were confused about.

So where do i stand? I still have my bike licence but thats not the point, they made a mistake 3years ago and now because of their actions leaves me totaly left in the shite house!
As you can tell im NOT happy one bit.

Do i just swallow it and re do my car test which means changing all my test dates etc which at my age will effect my insures alot or do i fight my case? or do i have no case to fight.......

Any help would be great i just dont know what to do. Feels like iv been royally shafted and theres nothing i can do about it.

Cheers guys and gals

Sam

what a 'mare pal, i would just book for a test and get it over with, else I guess that you'll find yourself fighting with solicitor costs etc and will prob get the same result over what seems to be an administrative error, well that's my opinion anyhow  :icon_thumright:

surely with the original offence your policy would state that you were entitled to drive other vehicles if you were  :icon_scratch:

I suspect you are shafted. The DVLA revoked your car licence but mistakenly gave you entitlement back later.

Maybe you should speak to the CAB or to a solicitor, but honestly mate - I think your only way back is to do a fast access test.

There are companies out there that can get you through your licence within 5 days, at least the driving experience you now have will stand you in good stead.

What they've all said; whilst you are redoing your test though, I'd be going to Citizens Advice just to get confirmation.

cheers guys. Yeah if you lose one licence you lose them all. So when i lost my car licence i lost both car and bike. Then when redoing my bike i got both bike and car ones back.

iv been to Citizens advice and they didnt know what to say as they had never come across this type of case before.

iv booked my theory test already then will fingers cross when passed book my practical. I want to take them to court over unfair treatment i dont think they can make a mistake that big and just make out theyve done nothing wrong and just carry on, screwing me up big time for the next few months. Also costs etc. Could i try fight my case for compensation?

Hi Guys

Similar happened to me in 2000

the prosecuting copper followed a line of bikes that crossed double white lines (the bikes fooked off and lost him.

Me staying behind and being the first bike he caught up to i got nicked (I was not with the group at all but could prove nothing.

lost in court and ordered to retake test.

Lost everything including my Bussiness (mechanic)

Did a new 2 part bike test inc bloody theory test
and did a new car test which took 6 months to get as there was a huge waiting list at the time in sussex.

I was proper buggered and bike tester failed me first time to teach me a lesson as i lost him
A Hole said when i did the U turn i made a car take avoiding action (was no other vehicle withing 400 yds when i did my U turn).

Whole business was a pain in the arse and cost me 1000's because i couldn't drive customers cars.

I still have a phobia about crossing double white lines 10 years later.

unless the law has changed you have to do all tests inc a theory.

Regards
Rick
