Naughty Rascal's been at it again. ( Advice welcomed )
« on: July 04, 2008, 08:40:25 PM »

Three weeks ago I was pulled by the police for speeding, cautioned, and given a produce documents slip. :-(
I was clocked on a hand held device then stopped about 500 meters further down the road by a parked car. [naughty]
I have heard nothing since, so could someone out there please tell me how long the police can wait before sending me the summons? :icon_scratch:
It's driving me crazy not knowing my possible fate. [wall]  Please put me out of my misery.

first one is within 14 days ..... but can be brought up to 6 months

but after this you have more than likely got away with it  B-)

Thanks for the info, but are you saying I should have received a letter within 14 days or 6 months?

your lucky, here in nl we can get cam notices within 3 months.  and they will charge you 28 euros for breaking the limit by 3km/h with no points so its not worth contesting.  fuckin annoying getting in a fine 3 months later for a piddly wee offence you certainly dont remember.  Also if you get caught going way to fast you will have your bike confiscated till your driving ban is over or if you are really unlucky they will crush it

When you say you were cautioned do you mean actually 'cautioned' or just given a bollocking?

If you were given a producer presumably you've taken your docs in within the 7 days.

If not stopped & told that you're going to be reported for the offence, then they have 14 days to send the NIP (Notice of Intention to Prosecute) to the registered keeper of the vehicle.

Then they have 6 months to lay the case before a court in order for them to issue a summons for the offence.

Once this has been done, they can then fanny about for up to 3 years (yes really !   ) to send you the summons & drag you up in front of the beak!

Normally the whole lot is completed within a few months though.

Yes I was formally cautioned then given a bollocking.
I produced my docs the very next day, so that part of it was ok.

Just remember if/when a court summons comes in ask streight away for the calibration report for the handheld radar for that day, they quite often are not able to lay their hands on it and if they can't then you are off scot free, however if you just get a fine and points it may not be to your advantage to challenge it
