this is why our budgets are shit bands aren't selling cd's as it can be downlaoded for free which means less money for touring. Although now the industry is saying it is spending more money on touring to get more people to come as it is an experience you don't get of an I-pod. STOP DOWNLOADING....then I can get a pay increase  [rofl].....actually I don't give a shit

  :emb: I havn't done it for about two years now, and th eonly stuff I downloaded was to replace cd's that had been stolen. I'm on my fourth collection thanks to the crime in SA. I always buy my music. Just the way I feel being in the industry.

This will make your downloads painfully slow but 'snoop' on your traffic, its a non starter - They would have to look at all traffic that means your email, browsing, confidential information maybe, what ur kids are doing.. it ain't gonna happen - be like getting the postman to deliver all the streets mail to your house then opening it all before passing it on. Anyway all mines encryptes, can read it even if they wanted to...  :tongue3:

though scoob if they want to they can enforce more than you think, if its breaking the law An ISP has to sacrifice the information to the authorities.

we get a number of company contact us via abuse report that have logged IP's from our end users , that have been illegally downloading software etc..

we have to already handle this in a similar way to what they are quoting. otherwise we might face court action...

it sure is and its easy to snoop on encrypted data too...depending on the level of encryption....and yes the net is closing in but there will be companies that fight this and make it available much cheaper than it is now...its coming for sure...and although the record companies want to ban it the west is the only place where music copyright last 70 years after your dead...what the fuck...thats madness...4 or 5 years and that should be that...no more rights to it.  Si in the end asia with is greater population will win this war...not the west...well thats my opinion....

So in that case they must be snooping on what your downloading in the first place.  Most ISPs throttle the ports that the P2P networks use and not your total bandiwdth, so your Email and Web Browsing functionality are not affected.  How do they do this? Well they do packet inspection to find out what's in the headers of each packet heading your way, hence they are already looking at your data otherwise how could they tell what is web/email and what is P2P data.

What exactly do you have that's encrypted?  Yes you can run the torrents on an encrypted transfer, this means that it will be slow anyway as you need to find someone that is encrypting the data in the first place, so your P2P network becomes really small and therefore less data available = slower downloads.
Your email server may be a secure server of one form or another which would mean that your connection to it is encrypted, but if your on the surfing the web, most of what you surf is not encrypted.  In fact I would bet that unless your using personal details such as Debit/Credit cards then you won't have any encrypted data.  Most onlines stores these days allow you to browse the items and the site only becomes secure when you go to pay.

Not having a go or anything of the sort, just hoping that your not under the illusion that all your data is encrypted.

So the burnning question, If my mate Dave(!) downloads 2 or 3 album torrents every now and then, is the law likely to catch up with him or is he a small fish in a big ocean?  :dontknow:

I imagine it would depend on how closely to the law it's followed.  I would imagine that the ISP will have to step in and stop the downloading otherwise they could end up in court for allowing it to go on.  I could see this taking a while before it becomes law as there are so many what if's.......

For example my neighbour uses a wireless router without encryption on it, so what's to stop me jumping onto their Internet and downloading all I want from there.  It won't come back to me and they will be the one affected by the 3 strikes rule whilst I can merily enjoy my internet.

Glen is in a better position to comment on this and when the time comes he can tell us all how the land will lay.

Anyway can't post anymore I have to save my bandwidth to download as much as I can right now  [rofl] [rofl] [rofl]

the biggest point of what the discussion is, is the whole wireless unencrypted networks.....  But the impression I get is they will mark out clear terms that regardless of whether its your neighbour doing it , its you responsibility to look after your internet...

think of it like this, you don't leave you keys in you car unlock so you neighbours can use it...

So why should you leave your network unlocked  :dontknow:

we have it in our usage terms that if you network uses the usage down you pipe then you have to pay... regardless of whether you think its your neighbour... as the term clearly state owners responsibilty....

The powers that be could enforce ISP's to do this  :dontknow:
