ok we all do it,well i do anycase.

i was on my way to the airport monday morn, big line of traffic at lights.
i was 3 cars back pulling out of a side road. saw a young fella on a bandit 600
go racing along filtering, at least 30mph.

then it happend, a car turned right out of the line, and he went straight over the bonnet.
i saw it as clear as the day.

bloke that was turning right out of the line of trafic was an 'AA' driving
instructor. should he of looked or should the bike rider been more cautious?

just be a bit careful eh. the road is harder than you!

Not quite, its legal if done in a controlled manner and great care is excersied when doing so.

I wasn't there to see it so can't really comment. Im taking it the car turned right into a junction off the main road and the biker was going down the middle? If so, it could go 50/50, the biker should of been more cautious and not ploughed past at 30, going past a side road junction, for the lights to still be at red just a little further up the road....

Case was nothing to do with the actual legality of filtering, just the civil side of apportioning of blame & ergo costs in event of it going wrong.

Previously cases were settled on the precedence of a case from the 60's were the judge found the biker 80% responsible, this one basically says that it has to be judged on a case by case basis rather than automatically holding the biker as being 80% responsible, as this was an appeal court judgement it takes precedence over the previous high court one.

In this case it would depend on the details, but if the driver was just fed up at sitting in a queue & doing a U-turn, it sounds very much like the recent case in which the biker was deemed to be blameless & he was travelling at around 40mph IIRC.

Traveling inbetween stationary/moving traffic....ie on the motorway/freeway whilst there is a traffic jam/hold up.

if you filter at 5/10mph and are aware of those around you,
left,right ahead and are cautios you should see issues as they
unfold when the line of traffic is stationary.

this guy was a young fella blatting along.
the traffic was stationary because of a red light.
a car stopped to alow another car out from a side road on the left (the AA instructor).
there was no cars heading down towards him in the opposite direction.
he then turned right and the bike came down and SLAM!

obviously i feel sick for him but i belive its the bikers fault.

as i said earlier just be carefull, thats all i ment.

this is true, but please dont everyone start jumping to say im wrong. all i have said is that filtering is legally recognised, which is correct, because previously overtaking rules had to be reverted to as there was nothing written about filtering. there is now. im not saying what kind of filtering is condoned and i havent outlined what filtering means. i havent read the judgement yet, but it is fact that previously there was no legal acknowledgement of filtering and now there is. i.e. a specific kind of filtering is legal. when i find the judgement ill post it. you can then decide for yourselves.

we all do it and yes it's as dangerous as anything, I'm always thinking that I'm going to be knocked off when doing it, it's a big risk area of riding and always will be    as regards blame, depends on speed of the rider and if the traffic is moving I guess.  Hope he's ok and has learned a valuable lesson

On this side of the pond, we call it lane-splitting, and it is illegal.

Sucks for that guy, but it sounds like he should have been more careful

OK, biker seems to have been going a tad quicker then he should. HOWEVER, am proffesionally disgusted that a fellow Insructor had not had the common sense to check his drivers door mirror, and if he is moving at a very slow speed, his blind spot

What a WANKER , that is inexcusable. Maybe thats why he is a franchised Instructor, relying on the AA to supply him with pupils.
