No it won't mate, besides you can take the rod out whenever you don't want it there as it's only a couple of clamp screws I think.
If the coppers do stop you then tell them the truth.
That is an anti - wheelie switch officer as I've found the throttle on this particular model to be quite aggresive and I don't want to pull wheelies.
According to Big T he leaves it on for the MOT as it's not a problem.

Why don't you ask Dirty Bertie as he should be able to let you know if it's illegal as I'm no MOT expert myself.
