I would give it a try. Letter to the Highways Dept detailing the damage, cost, when, where etc asking for their proposals to compensate your loss. Give them say, 10 days to reply with an acceptable solution, stating that otherwise further action will be taken in the County Court for full recovery plus costs. You can download all the appropriate forms, or visit your local court, and do this yourself.

Difficult to do, a mate of mine came off his bike after hitting potholes last year. Tried to pursue the local council through the insurance, took photo's of the road and everything. The council totally blew it off. Good luck with it but don't expect to get it covered. The bike was badly damaged and his own insurance had to cover it.

You can claim BUT you have to show negligence on their part.
IF they "weren't aware" of the pothole then it's very difficult BUT if hey were and hadn't repaired it then they are screwed.
That's straight from the highways guy at the council after I goosed a pair of alloys last year. I had to report the pothole THEN put the claim in afterwards WITHOUT getting the repairs done till then so the "dates matched" if you get my drift.......
