Tinted visors, a hypothetical legal question.

If riding thru town say, with a dark visor, but it is in the open position, are you still breaking the law?

Yep....I suppose it would be.  There is no legal requirement for the helmet to actually have a visor I don't believe.....

It always been an interesting argument, I mean....what about open face harley lads with big black shades on?  Is there any difference? You can't have tinted windscreens, but you can have shades on when driving?

Do it passed a copper and a let us know how you get on  [rofl]

Just been thinking about it, and suppose the law is about when conditions deteriorate due to poor light.  Dark visors with + 50% tint are illegal as technically are fixed in place.  I know once when I got caught short in Wales late one summer evening with my black Arai visor on and the journey back was borderline dangerous.   I do always carry my clear visor now anyway if there is a risk of low light.

I've never actually owned a dark visor but need a new visor now anyway and was thinking about one. Very seldom ride at night. Where do you carry the clear one, wont fit under the seat? How about clear safety glasses for if you get caught out? Same as wearing shades and an open visor! Sort of!

Got pulled for having dark visor on middle of the day bright sunshine, he said they have to be able to see your face (ok in afull face difficult)  i said what about oakleys on he said loop hole in law. Then i said what about the helmets with the retractable inner visor he said their retractable so i looked at him with my helmet on and lifted my visor he didnt say anything. Luckily he only gave me a warning so didnt want to push him too much my self i think in bright sunshine in day time think its safer and not  a problem hey but thats me.

Been out for last 5hrs and 200 miles on the 10R today  :headbang:

My helmet has a dark visor on and haven't been stopped yet! there were some great sunny spells and I was glad I had the visor on.

I have to say, any police officer who can't use common sense in such a situation of riding in bright sunlight must be a complete c0ck. Wearing them at night, then you should have the book thrown at you  :icon_thumleft:

Im pretty sure the law states yo uhave to wear a visor if the helmet was fitted with one when manufactured. The reason your allowed dark shades is becuase they are removable, as are the inserts used. If your riding with a dark visor, even with it up your breaking the law.

I always rode with a dark visor but carried my clear one across my stomach under my back protector (us skinny guys can do this easier)

The law on dark visors is pretty shit and should be changed so everyone is reading off the same hymn sheet. However i can see its purpose as have been caught out at night with only my darkie on.. Riding with it up at over 30mph isnt nice and flies hurt!

on my occassional and very rare rides, before anyone has a dig  [whistle]   I always carry a clear visor so if stopped or more importantly if the light changes I can put it on. You can use these visor bags



we all know that the law is an arse with regards to visors but it's there and if caught we know there's a fine.

For me the whole problem is where people ony carry a dark visor and risk their lives when the light conditions are poor  :-/

problem is everyones perspective of whenit's dark is probably differant. Also a photdhcomatic visor would cause problems if for instance thee was alot of street lights or a lot of on coming cars?

I carry an Oxford bumbag and it has a slot to take a visor and I carry wallet and phone in there. Althouhg the wallet never comes out.

Thing is if you are buying a new visor just carry your old one as a precaution, doesn't hurt. I also used to carry mine inside my leathers around the side of my stomach, never knew it was there

There is an important question of law that is missing here;
Dark visors are not waranted shatter proof like your clear road visor (lacks the BS marking) and it is THAT which renders them illegal and not for road use.
It is illegal not to have a visor fitted to a helmet if it was designed to take one. The law is very silly like this as it is ok to have an open face helmet. Having spoken to traffic cops they perceive dark riders to indicate aggressive riders and it is an EASY EXCUSE to be stopping you, few prosecute though for that alone Excess speed +naughty plate+dark visor begins to fail their attitude test though. They prefer you to wear shades in your lid. These will cut and injure you in an off. My early ride to work when it is sunny is DANGEROUS with my clear visor, I am blinded by the low sun so much prefer my dark visor. I have been caught out in the dark with a race visor and it is bloody dangerous but I think most people/police use common sense, day time and the offering of a clear alternative being carried is fair dingcom. Most police don't know why the visor is not for road use (the shatterproofness lacking) though the darker visors would fail a "tintman" test, this is a device that they test light penetration on tinted car windows that boy racers black out there car windows with. It has been no biggy in my 20 years riding but I would expect to be done if I got stopped in the dark wearing one. Other than that its no drama really.

that is a different slant on the point  :icon_thumleft:,

so, when considering racers you are in effect stating that they are riding with visors that aren't shatterproof, somehow I doubt that as I've never heard of a racer taking injuries due to a dark visor that shaterred  :icon_scratch:  of course they may not best formally tested but would valentino etc take a chance like that in their high flying  career, i certainly wouldn't
