Witness to a small collision

Whilst sat in a long line of traffic on a normal road a motorbike was filtering slowly past the suddenly the motor two cars up pulls from the queue and knocks him off. So i got out the lady is upset and the biker to his credit was quite calm and not much damage to either. Leave my details on went on with my day.

What got me thinking is who is in the wrong the woman for not looking properly or the biker for filtering.

filtering isn't illegal,so as long as he was doing it legally (as in not over solid lines etc) then she is.

Nope been a new ruling - if the biker is filtering in accordance with the law (correct speed, not crossing solid/hatched area, etc) then the woman is at fault.
Problem is most insurers will ALWAYS go for the biker or at best 50/50.
Talk to BBC Tom as he does this for a living.

Agree with HammeyUK,  and unless its changed since 2006 :

In Davis vs Shrogin, the judge found that, and I quote,  "a filtering motorcyclist passing stationary or very slow moving traffic could not be to blame if a collision occurred, if the rider had no chance to take avoiding action."
