hi my brother just got pulled on his 125cc by a cop said he was doing 38 in a 30 the cop said he will be geting 6 points he didnt get any papper work ect just showed the policemen his licence. Do you think it was a scare or they will do him. just would have thought be would have been issued somethink.

Either copper was trying to put the frightners on, or he got him for something else as well eg. no L plate (assuming he's on a 125 as he's a learner), bald tyre etc.

To be honest at that speed he could well get an offer to  just do one of those speed education courses & therefore avoid the points, though these vary from force to force.

he must be refering it the magistrate i would think or else he would have issued a fixed penalty there and then.?

As I say it seems to vary between forces, but the  ACPO guidelines for offering  the course are for exceeding the limit  by between 10% +2mph to 10% + 6mph so for a 30 limit that'd mean for doing 35-39  I think the reason some use a lower limit is down to the fact that they haven't the resources to run enough courses, so control the numbers by restricting the eligibility criteria.

Just a thought, has he got any existing points?  Because if he has 3 or more & is a new rider then totting up bans start at 6 points instead of the usual 12.  Could explain why plod couldn't give him a fixed penalty there & then.

As far as I'm aware, the courses are run by an independant body that have nothing to do with the police, so as to where the money goes  your guess is as good as mine

He could always ask for a speed awareness course, I know of someone who did and was given it.  If you don't ask......
