Driving without care and attention?

hi there, to cut a long story short anybody been done for the above offence? How many and how much?

got pulled over today by two police bikes and been told this is what i'm going to be charged with  :crybaby2:

online info says it can be from 3-9 points? (direct.gov.uk)

not whinging etc i was caught and accept the punishment etc

expecting points and a fine but told it was down to the courts to decide. is going to all happen by post.

so if you have been done for this what did you get?

What exactly did you do?  Can you mitigate in any way what you were doing?  Did you get distracted by something which made you lose concentration? The magistrates will use the guidelines you mentioned, when they decide on the penalty.  Its upto to win them over in court so you keep the penalty down, and they go to the lower end of the scale.

Its basically a theatre and you are on stage.  Dress smart, be articulate, take your time when answering questions and dont be over confident or cocky.............I'm sure you know all that anyway.  If you are admitting guilt, then you are halfway there, as you are not arguing against a copper.  But if you can in someway mitigate your behaviour or maybe show that you have exceptional riding ability, i.e. you do trackdays (riding instruction) or intend to do a police riding course........things that show that you are a responsible person 99% of the time, and that this was an unfortunate lapse in concentration.  Good luck dude.

Sorry mate, just realised that you are donig a postal hearing.  I've been in court a couple of times and always done ok.  By post is a bit of an unknown quantity.

i'm fairly sure he said it was all going to happen by post...

Can't really remember cause alot going on (good cop/bad cop routine) and i had to change a fuse too at roadside cause he pointed out that my tail light was out. (think tailtidy light has been playing up and shorted out the lot) Bike would have been impounded if not rectified  :shock: so once i'd done that too he said he'd let me off with dark visor and exhaust system. Think cause it was before dusk on my way home when pulled and about dark by time it was all over and back on my way. (visor atleast anyway)

He had quite a bit of knowledge about the ZX10R & was long serving police bike rider with 20 odd years under his belt along with instructing too etc

Good thing was he had a sense of humour though cause after being pulled over he asked me if it was my bike, to which i replied 'yes officer' To which he then said 'So you only ride it like you stole it then...'

it seems like once he caught you doing whatever you were allegedly doing, he then went to town a bit over the small things like the back etc, which is obviously not an issue, if you are not being done for those bots and pieces.

Its hard to know how to approach this without knowing what the circumstances are, and I know why you wouldn't want to potentially incriminate yourself by posting it on the world wide web.   You could have been wheelieing past a school at 100mph at 3.15pm, or maybe overtaking on a double white line..........however, if it is something that you could demonstrate that you were in total control, or maybe you were distracted, and can mitigate it, then its worth a shot in court.  For example overtaking a tractor doing 25mph, on a double white line with a clear line of sight, would not seem so irresponsible. 

You will probably get a letter, where you choose to go to court or not.  If it was me, i'd go.  I went once, and the coppers notes did not back up his case ( i was innocent anyway).  Sometimes they dont even turn up.  But it is your attitude and behaviour that will influence the magistrates more than anything.

good point Hammy!! Tony cover tattoos!! and wear uniform. U know in current political climate as a member of forces u might be treated differently-use it as your advantage, and good luck mate.  :icon_thumright:

I got done for 'due care and attention' back in 1997 after an accident on my GSXR 600

Got 5 points but cant remember the fine

when they did me 4 no insurance in 97 i did mine by post the fookers must have thought i couldent be botherd to go and did me good style 8 points and 600 fine
wished id have gone coppers said it was pointless bastards any way my advice is to go to court  :mad: :mad: :mad: :mad:
