i thought the shock would foul if put on a 1st gen...

Nope its just the res is the other way round on the 06/07 to clear the exhaust. The length is the same and the res is in the same place too - just the adjuster cap is on the left not the right.

An Ohlins or WP for an 04/05 won't fit the 08/09.
The WP for the 06/07 won't fit the 04/05 or the 08/09 as the res faces backwards and fouls the casting.

The Bitubo has the res above it and its adjustable too.
