can it be mounted so that the bottom is out towards the wheel more?

One of the guys on the GJ forum recently got busted for exactly the same offence.

His is mounted in a very similar manner. The plod that stopped him also had him for the plate not having a light showing onto it .....

Daytime MOT's are OK - but you can still fall foul of construction and use regulations.
