my mate with a new r1 was pulled and charged doing 104mph on the m6 yesterday, will he get a ban or fine and points?

i've been told there is no set rule and some courts will ban you and others won't, he was sitting at 85 and rolled on to pass a car and then rolled back off.

Well as it says here, he was just over the minimum speed for prosecution so who knows. Shouldn't think he'll get a ban though

all depends on the magistrate really,i'd guess at 300+ fine 6pts.

that seems to be the way, he does have a clean licence though and needs his licence for work so fingers crossed. he told me last night that he was doing 85 and rolled on to pass a car and noticed a car about 400yds behind but couldn't make out what it was as the sun was in his eyes, so slowed to 75 in the inside lane, 3mile later he got pulled.
also said plod would not have stopped him if he had been doing about 90, but 104mph was too much

Its a very long time since i looked at the highway code (22 years) but im sure i remember something about being allowed over the speed limit to expedite an overtaking manoevre as long as you return to the speed limit after the overtake. I think this is more to do with minimising the amount of time spent on the wrong side of the road so unlikely to be a defense on a motorway but might be worth looking into.

even if this is still true i think they might mean like 80ish not 104mph unfortunatly
