well guys i guess it was only a matter of time but i lost my licence yesterday, some fuckin twat in a police van felt that i was driving like i was on a race track (i never went above 70km/h) but was pretty low in the corners, Anyway the bastard stopped me and because i never had my licence on me(my son had emptied my wallet and my wife put everything back inexept my licence) I got arrested.

When i told them my wife was 9 months pregnant(due on sunday) they told me i was a liar and that she would have to come in even tgho there was no way of her getting there, after my wife got the doctor to call them they believed she was and went and picked up my documetns fromt he house themselves.

Anyway be carefull when you are here because this was a single cop in a van, no video evidence or anything just his word and i have lost my licence, i have just got to wait 10 working days to see how long they will keep it for, BASTARDS!!!!!!!!!!

I will admit that i do occasionally break the speed limit do wheelies etc but this guys was jsut taking hte piss and i am soooo pissed off that the police can do you with absolutely no proof of anything.

I feel for you chap. Due to get my license back in 11 days time after a year using pedals. Not even been able to do trackdays cos it was for medical reasons.

Get yourself a good brief.  Sounds like a load of shit to me.  Dangerous driving or driving without due care and attention is notoriously difficult to prove in the courts so they hardly ever try to go for it.  He can't do you for speeding in the abscence of any evidence (unless you admitted it when questioned).  You don't have to carry your licence either, it's not a legal requirement.  They should also only detain you if they see you as a risk or suspect you have committed an offence that would earn you 5 years in prison.

I would ask to speak to the duty inspector and find out exactly what you have been charged with and ask why they have retained your licence.  Sounds like total bullshit to me mate.

Sorry mate....didn't know you were abroad.......in that case you are royally fucked.  Fat, gay Dutch cops have no sense of humour.

They've probably sold your bike for parts on ebay by now

there is a case where a motorcyclist was prosicuted for dangerous driving for getting his knee down.

his expert witness to contest it was a professional motorcycle racer who said that it actually improved stability of the bike and was a good judgement of wot angle you were actually at which is very difficult to tell any otherway as you dont look at the ground.

leaning a bike over IS NOT AN OFFENSE

2 yrs ago i had a lowside accident on my rsv factory. an off duty plicewoamn following said i leant over so far it caused me to lose control.

cut a long story short i contested her opinion as she never rode a motorcycle and offered video evidence of me riding dragging knees proving my ability and disproving me leaning about 45 degrees causing me to loe coontrol (it was damp and frosty - think that might of caused it lol)

anyhow police dropped all charges after 3 interviews - the final one with a motorcycle traffic police officer who told the interviewing police officer she was talking twaddle and you lean a bike to go rund a corner...

fight it pal never admit anything and you WILL win

The definition of dangerous driving is that you are not in control of the vehicle.  A friend of mine overturned this penalty in court.

He was a BSB privateer, and was pulled for speeding (100+) on the m/way.  They tried to throw the book at him for dangerous driving.  Because the crown is prosecuting you, you can get free representation, which he did.  His brief demonstrated that he was in total control, despite his speed.  Charge was dropped, and just a got a few points and a fine, which is a big difference toyour driving record for insurance etc.  He was able to prove his ability because of his racing career, which could also be done by anyone who races or has a racing background.

It is always worth putting as much pressure on the system as possible, especially if an over zealous copper is throwing the book at you.  If you have done something horrendous, and are just getting a slapped wrist, then its best to shut up and move on, but if they are being excessive, then take them on.  I did it, and when it got to the magistrates court, the coppers notes were inconsistent and the brief picked him to pieces, as he probably didnt expect it to go that far.  Magistrates are only civilians with no legal qualifications, so a good strong justified common sense arguement can go in your favour.  As long as you dont alienate them by losing your temper, or by showing disrespect, and just put across your case in a decent articulate way, you take the CPS on and win.  Dont fall for the tricks of prosecution lawyers, who will try to make you agiated by cutting you off mid sentence and put words in your mouth to try and make you angry, which obviously makes you look bad.  Just stay cool, look the magistrates in the eye and be sincere.  They get just as pissed off with the old bill bringing ridiculous cases like this to court.
