has anyone got an experience like mine before??? if so what was the outcome, i am trying to work out if its worth trying to get this sorted via insurance or to just flip the guys car on its roof as has been seen on here before.

how it happened,
1/ When looking at the pictures remember i am in the netherlands so its the other side of the road.
2/ It wasnt my bike, it was a courtasy bike whilst mine was in getting jigged a bit. There is only around 200 euros damage to the bike so the bike shop doesnt want to waste time with going thru the insurance company incase the case goes against us and we are charged the damage of the car. This does not matter tho because my own insurance company can pick up the clain on behlaf of me for the clothes, injuries etc
3/ I was driving down the motorway in the middle lane(at about 30 - 40mph), another 2 lanes joined from the right to make a path to the next motorway exit and let people on to the motorway (see the pics attached)
4/ Anyhow, the guy in the fast lane swerved over and i colided with the rear passenger side of the car got spun off into the slow lane where the third car ran over my shoulder etc.
5/As usual no wintesses bothered staying around till the police arrived, The guy who ran over my shoulder got in his car and drove off when he heard he went over me, the other guy told the police that he didnt see what had happened he was just sitting in the fast lane not intending on leaving it and i somehow colided with the back side of his car. The police have said this is an insurance matter not a police one.
My problem is that its my word against his in the end of the day even tho it was a traffic filled road, i've not seen the damage to the car but can imagine what it would be like so it must be possible to work out what happened from the damage.
So kick his ass or take the legal route?
? might try one of the no-win no-fee things maybe, tell them i have major whiplash etc
